Spring Valley Tract with North at top of Survey




This deed made this 15 day of August 1851 between Robt. W. Nelson and Virginia his wife of the one part and Richd J. GILLIAM of the one part all of the county of Powhatan & state of Virginia witnesseth that in consideration of the sum of one thousand dollars, one hundred and ten dollars to the said parties of the first part by the said part of the second part in hand paid the receipt whereof is hereby acknowledge the said parties of the first part do grant unto the said party of the second part his heirs and all that tract of land situated in the County of Powhatan & state of Va. containing by survey herewith filed 92 1/2 acres and in said survey accurately described by metes & bounds, it being a portion of the Spring Valley tract now is the possession of said Nelson & to him conveyed by deed from Danl Stringer and wife, bounded on the east by the lands of said Nelson, on the west by the lands of Thomas Fuqua, on the north by the James River and on the south by the River Road, with all the improvements thereon & appurtenances thereto appertaining and that said parties of the first part do covenant unto the said party of the second part a perfect title in fee simple in & to the said tract of land & appurtances against all persons whatsoever—

Surveyed for a conveyance from Dr. Robert W. Nelson to Richard J. Gilliam, Esq, ninety two acres and a half of land as appears on the face of the above plot, laid down at 40 poles to the inch.

Powhatan County, to wit
We Joseph Royall and Wm Wren Justices of the peace for the county of Powhatan in the state of Virginia as certify that Virginia the wife of Ro W. Nelson where names are signed to the writing above bearing date on the 15th day of Augt 1851 personally appeared before us in the county aforesaid and being examined by us privily and apart from her husband and having the writing aforesaid fully explained to her she the said Virginia acknowledged the said writing to be her act and deed and declared that she had willingly executed the same and does not wish to retract it.
Given under our hands this 17th day of Novem 1851.

Powhatan County court Clerk’s office
Novem the 21 1851

This day the foregoing indenture of bargain and sale was acknowledged before me in the Clerk’s office aforesaid by Robert W. Nelson a party thereto to be his act and deed and the same having been acknowledged by Virginia S. Nelson wife of said Robert W. Nelson before two magistrates of this county and certified, was thereupon together with the certificate of the acknowledgement aforesaid and with the plot annexed to the said deed admitted to record.

Whereas Richard J. Gilliam of the county of Powhatan and State of Virginia stands justly indebted to Ro W. Nelson of the said county and state in the sum of one thousand one hundred and ten dollars by his two several bonds each bearing date the 15th day of August 1851 one executed in the sum of $555 with legal interest thereon from date payable twelve months after date, the other executed in the like sum of $555 with legal interest thereon from date payable two years after date for the purchase of a tract of land in aforesaid county and state by said Gilliam from said Nelson and whereas the said Gilliam is anxious to secure more effectually the payment of the said bond with interest as aforesaid. This deed made this 15th day of August 1851 between Richard J. Gilliam of the one part and Jno F. Lay of the other part witnesseth that the said Gilliam doth grant unto the said Lay the following property to wit, a certain tract of land situate in the county of Powhatan and state of Virginia containing by survey 92 1/2 acres, it being a portion of the Spring Valley tract purchased by said Gilliam from Ro. W. Nelson and conveyed by deed from said Nelson and wife to Gilliam said deed bearing date 15 of August 1851 and of due record in the court of Powhatan County, bounded on the east by the land of said Nelson, on the west by the land of Th. S. Fuqua, on the north by James River and on the south by the River Road as more accurately set forth one said deed with survey therewith filed. In trust to secure the debt aforesaid of $1110 with interest thereon as aforesaid according to the term and affects of the bond aforesaid from the said Richd J. Gilliam to the said Ro W. Nelson as order and for the purpose and none other the said Gilliam doth convey to the said Lay full and simple title to the said tract of land and all improvements thereon and appurtenances thereto appertaining

This day personally appeared before me Richd J. Gilliam a party to a certain deed hereto annexed and acknowledged it to be his act and deed and desired and to certify the same to the clerk of the county court of Powhatan in order that the same may be a recorded. Given under my hand this 17 day of Novem. 1851.

This day the foregoing deed of trust was acknowledged before me in the office aforesaid by Jno F. Lay a party thereto to be his act and deed and the same having been acknowledged by Richd J. Gilliam another party thereto to be his act and deed before a magistrate of this county and certified was thereupon together with the certificate of the acknowledgment aforesaid admitted to record.
